A Typical Social Security Case Timeline and Explanation

APPLICATION:

After we file your disability application with Social Security, they will send you forms to complete, and might also send you to their doctor(s) for examination. As you inform us of your medical treatment, we will relay the information to Social Security so they can review your records for a decision. The estimated time for this level of the process is about 3-9 months. 

RECONSIDERATION:

Your initial application will more than likely receive a medical denial (allowing only 60 days to request a reconsideration). An appeal of the initial denial is almost always proper. Once we do that for you, we will continue to collect medical evidence and relay the information to Social Security so they can review these records for a decision. The usual time your case spends at this level is around 3-9 months.

HEARING:

You will more than likely receive a second denial after a request for reconsideration (allowing only 60 days to appeal). Once appealed, you will receive a letter from the Office of Hearings Operations (OHO) stating they have received your file. You may also receive a letter from OHO asking you to consent to a video or audio hearing; As you inform us of your continued medical treatments, we will request your records and submit them to OHO. 

The approximate time for a final Social Security hearing to be scheduled is currently about 6 months; OHO office waiting times vary depending upon the particular OHO. A hearing notice must be issued at least 75 days before the hearing; After we receive the notice of hearing, we will schedule an appointment with your attorney to prepare for the hearing. After a hearing is held, it usually takes OHO 1-5 months to decide; it may take longer. 1f you are approved, it may take about 1-6 months to receive your benefits.
